TERMS OF SERVICE

1. DEFINITONS
In this instrument, we understand the following expressions according to the following definitions:
MR ROCCO: MR ROCCO INTERNET LTDA, a legal entity of private law enrolled as number nº 19.675.774/0001-40 in the National Registry of Legal Entities (“CNPJ”), in the Trade Office of the state of São Paulo, located at room 51, Doutor Martin Luther King Avenue, nº 630, in the city of Osasco/SP, Zip Code 06.030-003.
APP QUIZ: system consisting in a mobile application, offered by MR ROCCO and owned, operated and responsible by MR ROCCO, where all USERS can view and use the services offered by MR ROCCO.
DATA PROCESSING: Means any operation or set of operations which is performed by MR ROCCO on USER personal data or on sets of USER personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
USERS: Person or legal entity that accesses or uses the features available on the APP QUIZ.
2. AGREEMENT
This instrument regulates the conditions of use of APP QUIZ services, being a contract between USERS and MR ROCCO. The use and / or access to our services expressly indicates that you agree to all the terms and conditions contained in this instrument and the legal provisions applicable to the document.
YOU UNDERSTAND AND AGREE THAT MR ROCCO WILL CONSIDER THE USE OF THE SERVICES PROVIDED ON THE APP QUIZ AS ACCEPTANCE OF THESE TERMS OF USE AND SERVICES AND ALL OTHER LEGAL PROVISIONS RELEVANT TO THE SPECIES.
BY ACCEPTING THE TERMS OF THIS INSTRUMENT, YOU EXPRESSLY AUTHORIZE THE PROCESSING OF YOUR DATA BY MR ROCCO FOR MAINTENANCE AND PERFORMANCE OF APP QUIZ FUNCTIONALITIES.
THE USER, THROUGH THIS INSTRUMENT, EXPRESSES ITS COMPLETE CONSENT TO THE PROCESSING OF THE DATA COLLECTED BY MR ROCCO, UNDER THIS INSTRUMENT, WITH OTHER COMPANIES THAT MAKE PART OF YOUR ECONOMIC GROUP, OR ARE THEIR SERVICE PROVIDERS.
If you do NOT AGREE to the terms of this agreement, DO NOT access, view, download or use any MR ROCCO page, content, information or service.
3. WHO WE ARE AND WHAT WE DO
MR ROCCO is a private company that offers the APP QUIZ made up of mobile applications available in the Apple Store and Google Play. In it, USERS can access and have fun with the quiz games of biblical content. Thus, APP QUIZ allows its USERS to learn and entertain with Christian games.
4. USING OUR SERVICES
MR ROCCO only offers the APP QUIZ that provides biblical content to USERS, its responsibility being limited to the correct functioning of the APP QUIZ and its functionalities, according to this instrument, and MR ROCCO has no responsibility for: (i) damages of any kind related to the use or inability to use the APP QUIZ by the USER; (ii) any advertising content offered through APP QUIZ; (iii) content of third parties inserted in the APP QUIZ; (iv) any other act or fact from the conduct of the USERS.
MR ROCCO makes it possible for USERS to access the various features and functionalities available on the APP QUIZ and to use them free of charge.
HOWEVER, MR ROCCO MAY CONDITION THE ACCESS TO CERTAIN FEATURES OF THE APP QUIZ TO THE PAYMENT OF PLANS.
The USER, when using the APP QUIZ, may receive notifications of advertisements as well as messages from MR ROCCO. Notifications forwarded to the USER may take place through different means of communication, such as: email, SMS, push notifications, postings on the APP QUIZ.
This Term of Service grants to USERS a revocable, non-sublicensable, non-exclusive, non-transferable license to use the APP QUIZ. Therefore, USERS will not be able to use or allow the use of APP QUIZ for any purpose not expressly provided in this Agreement of use. In this way, USERS will not be allowed, without limitation, to copy, modify, distribute, sell or rent the services provided by MR ROCCO.
It is the responsibility of the USER to have access to the necessary technology to ensure the proper functioning of the APP QUIZ. Failure to access the appropriate technology indicated and recommended by MR ROCCO may result in the inability to use APP QUIZ.
In the use of APP QUIZ features, users are not allowed to: (i) use offensive language; (ii) make defamatory comments, against any person or legal entity; (iii) make comments or publish images that may infringe on the rights of third parties, be contrary to morals and morals, incite violence, hatred, sexism, racism, pedophilia, weapons, drugs, pornography and other disturbing or illegal content; (iv) publish third-party images containing personal data such as contact phones, e-mail, etc.
5. REGISTRATION
The services offered by MR ROCCO are available to people who are over 18 years old and legal entities duly registered.
It is not necessary to register or login to use the APP QUIZ. However, in order to complete the questionnaires with biblical content you must proceed with the registration or login on the platform, which can be done through your profile on social networks: Facebook or Gmail.
USERS to register at the APP QUIZ, they need to provide to MR ROCCO the following information: email and name.
The collection of USER data is intended to identify the USER, as well as enable you to use a greater number of services and functionalities available on the APP QUIZ.
By agreeing to the terms of this instrument, the USER understands that the collection of your data is essential for the proper functioning of the APP QUIZ.
It is necessary to fill in all the data requested by MR ROCCO at the time of registration, so that USERS can use certain services and features of the APP QUIZ.
It is the responsibility of the USERS to provide, update and guarantee the veracity of the registration data, with no liability to MR ROCCO for any civil and criminal liability resulting from incorrect or incomplete data provided by USERS.
MR ROCCO may use all valid and possible means to identify its USERS, as well as to request additional data and documents that it deems pertinent in order to check the data informed. In this case, the use of the APP QUIZ by the USER is conditioned to the sending the documents and any data requested.
The USER will access his account in the APP QUIZ through a login and password, committing himself not to inform third parties this data, being fully responsible for the use made of them.
The USER may request information on the data collected and processed by MR ROCCO, free of charge, by sending a message to contato@mrrocco.com.br, and may request editing or deletion of this information at any time.
The USER undertakes to notify MR ROCCO immediately, through the contact channels maintained by MR ROCCO at the APP QUIZ, regarding any unauthorized use of its account. The USER will be the only responsible for the operations performed on his account, since access will only be possible through the use of a password of his unique knowledge.
The USER undertakes to notify MR ROCCO immediately, through the contact channels maintained by MR ROCCO at the APP QUIZ, regarding any knowledge of irregularities of other USERS that may cause damages to the APP QUIZ USERS themselves, to MR ROCCO or third parties.
Under no circumstances will be allowed the sale, rent or other transfer of the account of the USER.
Without prior notice or compensation, MR ROCCO can delete, cancel, block or disable registrations of USERS that are considered offensive, that infringe the terms of this instrument or the legislation in force.
MR ROCCO reserves the right to do not permit a new register of USERS who have already been canceled, disabled, blocked, excluded or suspended from the APP QUIZ. The creation of new registrations by persons whose original registrations have been canceled, blocked, disabled, excluded or suspended due to violations of MR ROCCO‘s policies or current legislation will not be allowed.
MR ROCCO reserves the right, unilaterally, without prior notice, consent or indemnity, refuse any request for registration of a USER at the APP QUIZ, as well as cancel, disable, block, delete or suspend the use of a previously accepted registration.
6. YOUR RIGHTS TO DELETING AND CORRECTING YOUR INFORMATION
– Deletion
The USER can ask to MR ROCCO erase or delete all or some of your personal data by sending an email to contato@mrrocco.com.br.
Please note that doing so may limit the USER ability to access certain functionalities of the PLATAFORM.
– Correction
The USER can edit some of his personal data storage in the PLATAFORM or ask to MR ROCCO change or update his data.
– Object to, or Limit or Restrict use of data
The USER can ask to MR ROCCO stop to process all or some of his personal data (for example, if we have no legal right to keep using it) or to limit MR ROCCO use of it (for example, if his personal data is inaccurate or unlawfully held).
– Right to Access and/or Take Your Data
The USER can ask MR ROCCO for a copy of his personal data provided through the PLATAFORM.
– Right to review automated decisions
The USER can ask to MR ROCCO inform about any form of automated processing of his personal data through the PLATAFORM.
– Right to data portability
The USER can ask to MR ROCCO send a copy of his personal data and may also transmit this data for use in third-party services.

7. SERVICES
After the USER make the proper access in APP QUIZ will be available the use of various tools related to the biblical questionnaires provided in the platform.
The APP QUIZ platform ranking sequentially ranks which USERS achieved the highest score by answering the questionnaires available on APP QUIZ.
In addition, questionnaires can be defined and configured by different Christian contents and levels of knowledge.
MR ROCCO reserves the right to include and / or exclude features on the APP QUIZ. Since the functionalities described above may be withdrawn from APP QUIZ at any time, in the event that MR ROCCO so understands.
The USER shall not use cheating, abuse, automated software, bots, hacks, modifications or any unauthorized third party software designed to modify or interfere with the APP QUIZ platform and its functionality.
8. OBLIGATIONS
The USERS are responsible for the use of your account, therefore we recommend that you do not share such information with third parties and, if this information is for any reason misplaced or hacked, USERS should immediately inform MR ROCCO, through the contact: contato@mrrocco.com.br, in order to solve the case.
It is the responsibility of the USERS to have the equipment with the minimum requirements for the use of the services offered by MR ROCCO.
The APP QUIZ shall not be used for any purpose other than what it was made available by MR ROCCO, so that it shall not be permitted:
a. Disclose, use or improperly modify the data of other USERS;
b. Transmit or send information of any nature that may incite, induce, or promote discriminatory attitudes, violent or criminal messages that violate good morals, or even contrary to public order;
c. Change, delete and / or corrupt third party data or MR ROCCO’s information;
d. Violate the privacy of any USERS.
Furthermore, it is strictly forbidden to violate intellectual property from MR ROCCO or third parties in general, that is, not respecting the norms referring to copyright, trademark, patent, through reproduction of material, without the prior authorization of the owner.
9. PRIVACY POLICY
The USERS agree and consent that MR ROCCO collect and uses information collected through the PLATAFORM and processes all this data in accordance with the provisions of this instrument.
The USERS accept and agree that:
(i) The Data collected and processed by MR ROCCO through APP QUIZ will be stored on the Google Cloud subcontractor servers, which are headquartered outside of the country and can be contacted through the email juridicobrasil@google.com.
(ii) The Data collected and processed by MR ROCCO through APP QUIZ may be transmitted to subcontractor Admob for advertising purposes, which may be contacted via https://support.google.com/policies/troubleshooter/.
(iii) The storage and processing of data by MR ROCCO will last for as long as the USER registration remains in APP QUIZ.
(iv) Any information provided is stored in a database controlled by MR ROCCO.
(v) The database may be stored on servers not located in the country where the USER is located or where MR ROCCO is located.
(vi) The servers are owned and operated by subcontractors of MR ROCCO.
(vii) The data collected and processed by MR ROCCO through APP QUIZ can be used for statistical studies in order to be published in different public media. The USERS’ personal data may never be shared with the general public in order to identify USERS.
When the USER access the PLATAFORM, MR ROCCO collect your Unique Device ID (‘UDID’) and/or your IP address. The information is collected in order to determine the aggregate number of unique devices using the PLATAFORM services, to track total usage, analyze data, and communicate with you more effectively. MR ROCCO combine this information with information from third parties to provide to the USER a better and more personalized experience and to improve the quality of our service.
Although using third party-managed computing infrastructure, MR ROCCO does not authorize the use of personal data of its USERS outside the scope of its engagement.
MR ROCCO chooses the world’s leading data security service providers, however it is not responsible for events beyond the ordinary edge of the information-technology environment, such as, but not limited to: hacking attacks and other security technology failures that may lead to the exposure of confidential information.
MR ROCCO protects all personal data of its USERS by using economically reasonable standards of technique and technology.
The USER hereby acknowledges that there can be no expectation as to the total security on the Internet against website intrusion or other irregular acts.
MR ROCCO reserves the right to provide USER data and information, as well as the entire system used in APP QUIZ, to its technical team, and may be made up of MR ROCCO employees and / or outsourced companies, who will be responsible for managing the security and reliability of APP QUIZ and USER data.
All members of the technical team, whether employees or outsourced companies, will sign a confidentiality agreement stating that they are required to keep all commercial, accounting, administrative, technological, infrastructural, technical information, ie any mutually disclosed data, under strict secrecy. as a result of the continued operation and safety of APP QUIZ, refraining from using them for their own benefit or those of third parties, and pledging to ensure that its partners, employees with employment relationships and third parties of their trust, informed of this obligation, do so too.
MR ROCCO is not authorized to provide the personal data registered by the USER to third parties, except as provided herein.
Any provision of these Instrument declared invalid or unenforceable in any jurisdiction shall, as to that jurisdiction, be ineffective only to the extent of such invalidity or unenforceability, without causing invalidity or unenforceability of the remaining terms or provisions of these Instrument.
10. GENERAL
The USER undertakes to keep its registration information updated, as well as to inform any verified modification, especially with regard to its email address, since this represents one of the main channels of communication between MR ROCCO and the USERS.
MR ROCCO may change this instrument at any time by simply publishing a revised version on our site. For this reason, we strongly recommend that the USERS always visit this section of our website by reading, periodically. However, to contribute to the good relationship, we will also send you an email informing about these changes.
This Agreement shall be governed by and construed in accordance with the Laws of the Federative Republic of Brazil. The Conflicts shall be definitively settled by judicial process, being elected the Central Forum of the Comarca of São Paulo, State of São Paulo, renouncing the parties to any other, however privileged it may be.
